Our website, and all of its components and resources, are intended to provide information to further the field of affordable housing.

Some of these resources belong to other organizations. If you want to share or reuse copy that belongs to someone else, you will need to contact that copyright owner to get permission. Enterprise encourages you to share Enterprise’s textual and infographic information, and Live Online videos freely, but please cite Enterprise as the source. Contact us for details.

BY VISITING THIS WEBSITE (“SITE”) AND USING OUR SERVICES, INFORMATION AND DATA, YOU SIGNIFY YOUR CONSENT TO THESE TERMS OF USE (“TOU”).

Throughout this TOU, Enterprise Community Partners, Inc. (“Enterprise”), its subsidiaries, affiliates and supporting organizations may be referred to as “we”, “us”, and “our”.

Use of Enterprise Websites

You agree that your use of this Site and sub domains will be governed by this TOU. The purpose of this Site is to provide information on the work of the Enterprise and the community development field. Throughout this Site, the business and products of Enterprise and its charitable and non-charitable organizations are presented.

Enterprise owns the copyright of this Site and the materials on this Site, except (1) the content owned by a Third Party (“Third Party Content”), which is licensed to Enterprise by such Third Party Content provider, and (2) other content that Enterprise reasonably determines as available materials for use on this Site. Unless expressly provided in this TOU, you should not construe the Site as granting, by implication or otherwise, any license or right to use any copyrighted content on the Site without the written permission of Enterprise or any Third Party Content provider that may own copyrighted content on the Site.

Enterprise will license its textual, Infographic, and Live Online video content under the terms of CC BY-ND 4.0, so long as you (1) submit a notice as outlined in the Website Content Usage Notification section of the Privacy Policy, at least 10 business days before your actual use of such desired content; and (2) covenant that you will not use the content in any way that is not disclosed in such notice. You may not gain profits from merely reproducing, redistributing, repackaging, or recompiling such materials, or from reproducing, redistributing, repackaging, or recompiling such materials as part of your product or service. “Infographic” content means two-dimensional geometric graphics and diagrams that convey symbolic representation of information, statistics, and data; it does not include aesthetic or realistic drawings or pictures, or any other kind of pictorial or photographic material.

Notwithstanding what the terms under CC BY-ND 4.0 and this TOU may state, Enterprise reserves the right to reject, at its sole discretion, the usage, or a part of the usage, which you have disclosed in the Content Usage Notice Form or which you have already put into use. If Enterprise does reject certain usage, upon receiving notice from Enterprise, you must stop the rejected usage immediately, and may not engage in such rejected usage in the future without Enterprise’s written consent.

For the avoidance of doubt, in no way may this TOU or CC BY-ND 4.0 be interpreted to allow you to change the substance of our content, modify it in any material way, or produce any kind of derivative work.

Notwithstanding what the terms under CC BY-ND 4.0 and this TOU may state, certain materials on the Site are not available under CC BY-ND 4.0 license. These materials include, but are not limited to: (1) Enterprise’s trademark and trade dress; (2) the source code of this Site; (3) all data stored in Enterprise’s online portals and communities; (4) software; (5) all drawn, graphic, pictorial, photographic, and diagrammatic content, except Infographic content as defined above; (6) all audio, video, and audiovisual content, except the Live Online videos produced by us; and (7) services and other content identified as unavailable material by Enterprise. You will need to acquire written consent from Enterprise or the Third Party Content provider before using such above mentioned content, if you intend to use any of such content, or any content other than textual, Infographic, and Live Online materials, please Contact us. Visitor Posting Information and Linking to Websites

Any resource allowing you to link to or post information is available for use so long as the content in the posting or linked website (1) is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and (2) does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam."

As a condition to linking to the Site or posting information, you promise not to use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of a comment or other content. We reserve the right, but not the obligation, to remove or edit content not in compliance.

Unless indicated otherwise, you grant us a nonexclusive, royalty-free, perpetual, irrevocable, and fully licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You also grant us the right to use the name that is submitted by you in connection with such content.

We have the right but not the obligation to monitor and edit or remove any activity or content. We take no responsibility and assume no liability for any content posted by you or any third party. "Your Information” means any data, content, code, video, images or other materials of any type that you upload, submit or otherwise transmit to or through our Site.

The Site contains links within our Site and to third party websites we believe may be instructional for you. Links or any references to other pages and sites do not constitute or imply endorsement, recommendation, or preference by us. You understand that when a link is provided, we do not control, endorse, approve, or certify the content or warrant the offerings of those addresses. Intellectual Property Rights and Trademark Notice

We maintain all rights, title and interest in and to all our respective copyrights, Marks, domain names, software applications, trade secrets, and any other intellectual property and/or proprietary rights (collectively, "Intellectual Property Rights"). You will retain all right, title and interest in and to Your Information in the form provided to us. Disclaimer of Warranties Limitations of Liability and Indemnification

This Site in no way should be construed as rendering any legal, accounting or any other project specific advice. 

This Site is provided on an "as-is" and "as available" basis. We, our employees, officers, trustees, directors and agents and Third Party Content providers assume no responsibility for, and expressly disclaim any liability resulting from, the use of any material contained on this Site.

Choice of Law; Forum Selection
These TOU and all the other applicable policies regarding this Site are governed by the laws of the State of Maryland, exclusive of its conflicts of law rules and federal law. You agree that any suit, action or proceeding instituted with respect to any actions resulting from the use of this Site will be brought in any state or federal court located in the State of Maryland and you consent to the personal jurisdiction of such courts. You irrevocably waive any objection to, and any right of immunity from, the jurisdiction of such courts or the execution of judgments resulting there from, on the grounds of venue or the convenience of the forum.

Severability
If any term in this TOU is held to be inconsistent with any present or future law, ruling, rule or regulation of any court or authority having jurisdiction over the subject matter of this TOU, such provision will be deemed to be rescinded or modified to the minimum extent necessary to comply with such law, ruling, rule or regulation, and the remainder of this TOU will not be affected thereby.

Modification
We reserve the right to modify the terms of this TOU at any time in its discretion. The terms of this TOU in effect at the time of your use will be the operative terms governing your use of this Site.

Enterprise Community Partners, Inc. and its affiliated entities (collectively, “Enterprise”) are committed to maintaining your trust by respecting and protecting your privacy. This Privacy Policy (“Policy”) describes why and how we collect, use, and share Personal Information (as defined below) collected from individuals, such as prospective partners, business associates, residents, job applicants, and employees. The Policy also explains your choices regarding how we share your Personal Information and communicate with you, how you can request access to and correct your Personal Information, and other important considerations.

By providing us with your Personal Information or by using our websites or apps, you consent to our handling of Personal Information as described in this Privacy Policy.

Scope of Privacy Policy

This Policy covers personal information collected both online and offline by Enterprise. For the purpose of this Policy, “Personal Information” is defined as any data which can be used to identify, locate, or contact an individual.

This Policy does not apply to anonymous, de-identified, or aggregate data, which cannot reasonably be used to identify you – even when such data has been derived from Personal Information and/or publicly available information (i.e., information that is lawfully made available from federal, state, or local government records).

Types of Personal Information Collected by Enterprise

Types of Personal Information we may collect include the following:

Job ApplicationsThis may include information provided by the job applicant along with information obtained by Enterprise related to the application.
EmploymentEmployee information includes that related to pay, benefits, employment eligibility, personnel files, and potentially OSHA or insurance related documents.
Business PartnersIndividuals partnering with Enterprise provide information related to qualifications, contact information, and payment information.
Contact RequestInformation from individuals who reach out to Enterprise for information using electronic contact forms available on public websites.
Donors and FundersIndividual donors and funders who make financial contributions. Information may include name, contact information, charitable disclosure statement, and donation history.
InvestorsIndividuals making financial investments into Enterprise vehicles. Information may include name, contact information, financial investment, and tax information if necessary.
Residential Applications and HousingThis may include information provided on a purchase or rental application, or information associated with occupying a residential unit managed or owned by Enterprise.
VolunteersIndividuals who have acted, or shown interest in acting, in the capacity of a volunteer with Enterprise. This may include name, contact information, background information if necessary, and volunteer history.

Enterprise does not sell data or share Personal Information to a third party for cross-context behavioral advertising. Enterprise may share Personal Information to the extent necessary to perform services. These may include providing information to related Enterprise affiliates, business partners, or third parties in support of funding and residential services for our clients and residents. Enterprise may also share Personal Information with government agencies responsible for oversight of funding sources or regulatory oversight. 

Personal Information Enterprise Shares with Third Parties

Enterprise does not sell data or share Personal Information to a third party for cross-context behavioral advertising. Enterprise may share Personal Information to the extent necessary to perform services. These may include providing information to related Enterprise affiliates, business partners, or third parties in support of funding and residential services for our clients and residents. Your Rights Related to Your Personal Information

 Right to Access Your Personal Information: You have the right to request that we disclose Personal Information that Enterprise collected and retained about you.
 Right to Correct Your Personal Information: You have the right to request that any inaccurate information Enterprise retains on you is corrected. 
 Right to Delete Your Personal Information: You have the right to request that we delete Personal Information that Enterprise collected from you. This right may be balanced with the requirements to retain certain information and records in compliance with laws, regulations, contracts, legitimate business needs, and auditing from governmental agencies. 
 Right to Opt-Out of the Sale of Your Personal Information: You have a right to opt-out of the “Sale” of your Personal Information. 
 Right to Opt-Out of the Sharing of Your Personal Information: You have a right to opt-out of the “Sharing” of your Personal Information for cross-contextual behavior advertising. 
 Right to Limit Use and Disclosure of Sensitive Personal Information: You have the right to direct Enterprise to only use your sensitive Personal Information (for example, social security number, financial account information, precise geolocation data, or genetic data) for limited purposes, such as providing the products or services requested by Enterprise. 

Methods to Exercise These Rights

To exercise your rights described above, you may contact Enterprise in the following ways:

Processing Expectations

Enterprise does not discriminate against anyone exercising their privacy rights. Upon receipt of your verifiable request, Enterprise will work to process requests within 45 days. If Enterprise is unable to respond, Enterprise will provide written notice to extend the response time by up to 90 additional days where necessary, taking into account the complexity and number of the requests. Enterprise shall inform the consumer of any such extension within 45 days of receipt of the request, together with the reasons for the delay. If Enterprise is unable to complete your request, Enterprise will inform you of the reasons for not taking action and any rights you have, including the right to appeal the decision.

Verification of Identity: Only you, or someone appointed by you and properly registered with a recognized authority, may make a request with regards to your Personal Information. The request must provide sufficient detail to enable Enterprise to identify you, such as providing your identifiable information to cross-reference with any submitted data, and your deletion request with sufficient detail that allows us to understand that you desire to exercise your rights.  We do not require you to create an account and will only use any data submitted to us for a deletion request for that specific request.  

Using an Authorized Agent: You have the right to designate someone else to act on your behalf as your authorized agent to exercise some of your privacy rights. An authorized agent may need to provide documentation supporting the agent’s authority to make this request on your behalf, such as a signed authorization form.  Enterprise may also require you to verify your identity directly with Enterprise and confirm the request before Enterprise will process any request.

What is Do Not Track (DNT)?
