Disparate Impact Comment Letter

On August 16, HUD released a proposed rule that would revise the 2013 disparate impact rule. The disparate impact rule sets the standard for determining when a practice with a discriminatory effect violates the Fair Housing Act. Enterprise strongly opposes the proposed changes that would substantially alter the disparate impact rule and would make it far more difficult to bring disparate impact claims under the Fair Housing Act. On October 18, Enterprise, Housing Partnership Network (HPN), Local Initiatives Support Corporation (LISC), National Housing Trust (NHT), and Stewards of Affordable Housing for the Future (SAHF) provided comments to HUD, strongly opposing the proposed disparate impact rule and urging HUD to withdraw it.
