Sustainable Communities Initiative
In FY 2009, the Department of Housing and Urban Development (HUD), Department of Transportation (DOT), and Environmental Protection Agency (EPA) created the Interagency Partnership for Sustainable Communities (Partnership). The Office of Sustainable Housing and Communities represents HUD in the Partnership and administers the Sustainable Communities Initiative, which provides funding for communities to develop and implement regional plans that integrate housing, transportation, environmental, land use and zoning decisions.

Expanding Building Efficiency Incentives Act

On January 12, 2010, a group of industry supporters sent a letter to Senator Max Baucus (D-MT) and Senator Chuck Grassley (R-IA) (PDF, 95KB) in support of the Expanding Building Efficiency Incentives Act. Congress created the New Energy Efficient Home Tax Credit (Section 45L of the Internal Revenue Code) as part of the Energy Policy Act of 2005.  Among other provisions, this bill would extend the New Energy Efficient Home Tax Credit through 2013, and make several improvements so that the credit can be more effectively used for affordable multifamily housing. U.S. House Passes Historic Green Affordable Housing Bill

The U.S. House of Representatives passed the landmark HOPE VI Improvement and Reauthorization Act. The bill marks the first time lawmakers have authorized holistic environmental principles in a major housing program. Foreclosure and Neighborhood Stabilization

NSP Recapture/Reallocation Notice
On August 23, 2010, HUD released the Notice of Neighborhood Stabilization Program (NSP) Reallocation Process Changes. The Notice describes the corrective actions, recapture process, reallocation formula and waivers of regulations affecting grantees that fail to meet the 18-month deadline for obligating the first round of NSP funds (NSP 1).

Financial Regulatory Reform Foreclosure Provisions

The Wall Street Reform and Consumer Protection Act (H.R. 4173) included $1 billion for a third round of the Neighborhood Stabilization Program (NSP3), as well as a long-awaited vacant property legislative improvement so that vacant properties can count toward the low-income set aside in NSP.

Coalition Urges Regulators to Improve, Strengthen CRA
On December 15, 2009, a coalition of 19 housing and community development groups sent a letter “to urge the Federal Financial Institutions Examinations Council (FFIEC) to send a clear message that CRA-related lending, services and investments are a core responsibility, consistent with the safe, sound, and responsible operation of financial institutions.” The FFIEC consists of the FDIC, Office of Thrift Supervision, Federal Reserve Board, and Office of the Comptroller of the Currency.

Tax

Job Creation and Affordable Housing Act of 2010 (S.3326)
S.3326 would enact the five year carryback for new and current investors and would extend the exchange program to bond-financed housing. This legislation would help reinvigorate investment in the nation’s most successful affordable rental housing production program, while preserving and creating small business jobs (PDF 32KB).

Low-Income Housing Tax Credit Recovery Act (S.3141)
S. 3141, as introduced by Senator Bingaman, would increase the carryback period for the Low- Income Housing Tax Credit from one to a maximum of five years. Ernst & Young recently determined that this would bring in $5 billion in additional private LIHTC investments. The bill would thus reinvigorate investment in the LIHTC program and produce needed affordable housing while preserving and creating jobs. (PDF 32KB).

Low Income Housing Tax Credit Exchange Expansion and Job Creation Act of 2009 (H.R. 4687)
H.R. 4687 would extend the Section 1602 Low Income Housing Tax Credits (Housing Credit) exchange program for 2010 and expand it to include Housing Credits generated from tax-exempt bond-financed housing, commonly referred to as 4 percent credits. (PDF 95 KB)

Choice Neighborhood Program
The Choice Neighborhoods program was proposed by the Obama Administration in the 2010 federal budget. It has been designed as a successor to the HOPE VI program and would create a program of competitive grants to rebuild public and assisted housing into mixed income communities with access to quality schools, transportation, and other vital community services.
